Self Drive Terms and Conditions
(These Terms and Conditions do not affect your statutory rights)
Our Agreement
These Terms and Conditions form part of the Agreement attached.
When we refer to “We”, “Us” and “Our” in these Terms and Conditions we mean Country Lanes Classic Car Hire.
When we refer to “You” or “Your” in these Terms and Conditions we mean the customer whose details are on the attached Agreement.
We shall both be bound by the terms of the Agreement when You have signed the attached Agreement, returned it to Us and paid Us the (non-refundable) deposit by cleared funds.
We will not accept any changes to these Terms and Conditions unless agreed in writing by Us.
Payment
You must pay Us the full balance of the hire charge (less the deposit) as indicated on the attached Agreement no later than 14 days before the start of the period of hire.
If the period of hire is less than 14 days from the date of this Agreement then the whole hire charge is due and payable to Us on the date of this Agreement.
You can pay the hire charge (and the deposit) by Mastercard, Visa, Debit card or cheque with a valid cheque guarantee card.
If you do not pay Us when any hire charge is due and payable then We shall not be liable to You to provide the vehicle for the period of hire but You will still be liable to pay Us the full amount of the hire charge within 7 days of the date of Our invoice to You in this respect.
Cancellation
If You cancel this Agreement before or on the first day of the period of hire then You will still be liable to pay the following percentage of the hire charge:
Cancellation within 14 days of the first day of the period of hire – 100%
Cancellation more than 14 days before the first day of the period of hire – £25.00 only
If We cancel this Agreement (except in the case Where You have not paid the hire charge when it is due and payable) then We shall refund all of the hire charge (including the deposit) within 7 days of the date of the cancellation (unless You accept an alternative period of hire) and then We shall have no further liability to You.
Period of Hire
The period of hire shall be from 9:00 am on the first day of the period of hire until 7:30 pm on the last day of the period of hire.
If the period of hire is for one day only then such period shall be from 9:00 am to 7:30 pm.
If You return the vehicle after 7:30 pm on the last day of the period of hire You will be charged a late return charge of £[ ] per hour (or part of an hour) which shall be paid in full upon the return of the vehicle to Us.
Insurance and Breakdown Cover
The hire charge includes fully comprehensive insurance cover for the nominated drivers for the period of hire and breakdown cover with a reputable recovery service.
Nominated Drivers
Only nominated drivers are permitted to drive the vehicle during the period of hire.
All nominated drivers must be between the ages of 25 years and 70 years unless otherwise agreed by Us. Nominated drivers outside of this age range will incur additional insurance cover and this will increase the hire charge. Any increase in hire charge must be paid for by You before the period of hire commences.
You confirm to Us that all nominated drivers have held a full driving licence for at least five years.
You confirm to Us that no person who is a nominated driver has more than 6 penalty points on their licence or the equivalent in any foreign jurisdiction.
You confirm to Us that no nominated driver has been disqualified from driving in the five years prior to the commencement of the period of hire.
All nominated drivers must produce the paper and photocard driving licence to Us before the period of hire commences. You will permit Us to take copies of these documents for Our records.
You confirm to Us that no person who is a nominated driver has ever been refused insurance or had special insurance terms imposed on them, or had a policy of vehicle insurance cancelled by the insurers or has any physical or mental defect which affects their ability to drive safely.
There is an additional hire charge of £15.00 for every additional nominated driver.
Each nominated driver is required to produce to Us before the period of hire commences two further identification documents (in addition to their driving licence). One document must show their current address. Non-United Kingdom customers must produce their passport to Us and agree to this being photocopied and kept for Our records.
To be accepted as a nominated driver each person must agree to having their photograph taken in front of the vehicle by Us before the period of hire commences. This photograph will be for our records and those of Our insurers. Such photographs may also be used for promotional purposes by Us. By entering into this Agreement You agree to the photograph being used for this purpose. We will supply you with a copy of this photograph for souvenir purposes when You return the vehicle to Us at the end of the period of hire.
If You or any nominated driver fails to disclose any information to Us or provides Us with false, inaccurate or misleading information about themselves which affects Our insurance cover then You agree to indemnify Us in full in respect of all of our losses, costs, expenses, increased premiums and damages arising from or in connection with this failure.
We reserve the right without incurring any liability to refuse to permit You or any other person to be a nominated driver.
We will refuse to permit You or any other person to be a nominated driver if We consider that You or they are under the influence of alcohol or drugs when You arrive to collect the vehicle and we shall have no liability to You under this Agreement arising from this refusal.
Security Deposit
A security deposit will be taken from You on the day that the period of hire commences. This is required in the form of either a valid credit card pre-authorisation or in cash.
If the vehicle is returned to Us at the end of the period of hire in the same condition as when it was hired to You the security deposit will be returned to You. But if the vehicle is not returned in such condition then the full security deposit will be retained by Us until the repairs or cleaning are completed. If these costs are less then the security deposit then We will refund You the difference. But if these costs are more than the security deposit then you agree to indemnify Us in full for the difference over and above the level of the deposit and You will pay Us within 7 days of the date of Our invoice to You in this respect.
If the damage to the vehicle is caused by a third party then We will return the security deposit to You as soon as the full costs of repairs or cleaning have been recovered by Us from that third party.
Fuel
The vehicle will be supplied to You with a full tank of fuel. You must return the vehicle to Us at the end of the period of hire with a full tank of fuel. If you do not do this we shall deduct the cost of this from your security deposit.
If You put the incorrect type of fuel into the vehicle then You must not start the engine. You must report this to Us by telephone immediately. You agree to indemnify Us for the full cost of having the vehicle drained and for any other damage that may have been incurred to the vehicle arising from this. The security deposit will be set off against these costs. If the security deposit is insufficient then You agree to pay Us the balance within 7 days of the date of Our invoice to You in respect of this.
Mileage
If You travel more than the permitted mileage as set out on the Agreement attached then You will be charged [ ] pence per mile in excess of this and such sum will be due and payable by You when You return the vehicle at the end of the period of hire. Such sum will be deducted from the security deposit. If the security deposit is insufficient then You agree to pay Us the balance within 7 days of the date of Our invoice to You in this respect.
Animals
No animals of any type are permitted in the vehicle at any time during the period of hire.
Smoking
Smoking is not permitted at any time in the vehicle even if the vehicle is ‘open-top’ during the period of hire.
Limitations on Use
During the period of hire the vehicle shall only be used for domestic pleasure purposes. It must not be used for any business or commercial purposes whatsoever.
You must not hire the vehicle to any person, You must not teach anyone to drive in the vehicle, You must not use the vehicle for racing or rallying or any other sporting purpose and You must not use the vehicle for any immoral or illegal purpose or activity.
The vehicle must not be taken off the mainland of Great Britain.
The vehicle must not carry more passengers than the make of vehicle is designed to carry taking into account the number of seat belts.
Altering the Appearance of the Vehicle
You must not or permit any other person to alter the appearance of the vehicle or fix or attach anything to the inside or outside of the vehicle either temporarily or permanently. If you act in contravention of this and damage is done or cleaning required then the full cost of this will be invoiced to You and the security deposit will be used to set off all or part of the value of such cost. If the amount of the security deposit is insufficient You will pay the balance to Us within 7 days of the date of Our invoice to You in this respect.
Damage to Clothing
We shall not be responsible to You or Your passengers if there is any damage to clothing or personal items from any oil or grease on the door catches or hinges of the vehicle.
Alternative Vehicle
If the vehicle that You have selected to hire is unavailable for the period of hire for any reason beyond our control then We will advise You of this and We shall offer You an alterative period of hire for that vehicle or a suitable alternative vehicle for this period of hire. Such an event will not give you cause to terminate the Agreement.
Losses etc
If during the period of hire We sustain losses, costs, claims damages, expenses, fines or charges of whatever nature arising either from a breach by You of the terms of this Agreement or as a result of Your using the vehicle then You agree to fully indemnify Us in respect of all such losses, costs, claims, damages, expenses, fines or charges.
Equipment Supplied
The vehicle will be hired to You complete with keys, security devices, maps, route suggestions, spares kit and tool kit. All of this equipment must be returned to Us with the vehicle at the end of the period of hire. If any such equipment is not returned or is returned damaged then You will indemnify us for the cost of replacement and the security deposit will be used to set off all or part of such cost. If the amount of the security deposit is insufficient You will pay the balance of such cost to Us within 7 days of the date of Our invoice to You in this respect.
Security Devices
You must at all times use or apply all security devices supplied with the vehicle when You are not in the vehicle and You must lock all of the doors and the boot when You are not in the vehicle.
Personal Property
We do not accept any responsibility for any loss or damage to Your personal property which is left unattended in the vehicle.
Unfit Driver
You must not and You must not permit any other nominated driver to drive the vehicle whilst they are unfit to drive either through illness or due to intoxication through alcohol and/or drugs.
Theft of the Vehicle
If the vehicle is stolen then You must report this to Us by telephone immediately. You must also report the theft to the local police immediately in person and obtain a crime reference number which you must give to Us.
Vehicle Involced in an Accident
If the vehicle is involved in an accident You must obtain the names and addresses of all those involved and any witnesses. You must notify Us of the accident immediately by telephone and You must submit an accident report to us in writing within 12 hours of the accident taking place.
Your Vehicle at Our Premises
If you leave Your vehicle at Our premises during the period of hire You do so at Your own risk and We do not accept any responsibility or liability for Your vehicle or any personal property left in it.
